Munkaügyi vitákban történő közvetítés: mikor és hogyan működik

Mediation in a labour dispute means that an independent mediator helps employer and employee reach their own agreement, either to restore the working relationship or to end it on agreed terms. It is voluntary and confidential, and it works only if both sides still want a solution; if one of them refuses, the dispute goes to the UWV or the subdistrict court (kantonrechter).

In the Netherlands, mediation is often linked to sick leave. An employee who reports sick during a conflict keeps the right to continued pay for up to 104 weeks (Article 7:629 of the Dutch Civil Code (BW)), and the company doctor (bedrijfsarts) can advise mediation as a step in reintegration.

When is mediation suitable in an employment conflict?

Mediation suits a conflict in which trust has been damaged but both sides can still talk. It is less suitable where there is serious misconduct, intimidation or a large imbalance of power.

Typical situations are a disagreement about performance, a reorganisation that changes someone’s role, or a clash between an employee and a manager. If the relationship is left to deteriorate, the employer may later ask the subdistrict court to dissolve the contract for a disrupted working relationship (Article 7:669(3)(g) BW). The court then looks at whether the employer made a serious attempt to restore the relationship, and an offer of mediation is a common part of that attempt.

Mediation is not a way to avoid legal obligations. Where the employee claims unpaid salary under Article 7:625 BW or contests a summary dismissal under Article 7:677 BW, strict deadlines apply, and mediation does not stop them from running. A claim to annul a summary dismissal, for example, must be filed within two months (Article 7:686a(4) BW).

How does mediation work alongside sick leave?

The company doctor first assesses whether the employee is unfit for work because of illness, or whether the conflict itself keeps them from working. That assessment determines whether mediation can start and how quickly.

Under the Gatekeeper Improvement Act (Wet verbetering poortwachter), the company doctor draws up a problem analysis within six weeks of the sick report, and employer and employee agree a plan of action within eight weeks. If the doctor advises mediation, it is usually included in that plan. An employee who refuses without good reason to cooperate with reasonable reintegration steps risks suspension of wage payments (Article 7:629(3) and (6) BW).

Either party can ask the UWV for an expert opinion (deskundigenoordeel) if they disagree with the company doctor or about the employer’s reintegration efforts. That is often a useful step before or after mediation fails.

How does a labour mediation run?

A mediation usually consists of an intake, a few joint sessions and a written outcome. Both sides first sign a mediation agreement that records confidentiality, the voluntary nature and who pays.

  1. Choosing the mediator: many labour mediators are registered with the Mediators Federation Netherlands (Mediatorsfederatie Nederland, MfN), which sets training and quality requirements.
  2. Intake: the mediator speaks to each party, often separately, to understand the conflict and check whether mediation can work.
  3. Joint sessions: usually two to four sessions of a few hours, in which the parties discuss the underlying issues and options.
  4. Outcome: agreements on working together again, or on ending the employment contract, recorded in writing.

In practice the employer pays the mediator in an employment conflict, and each party pays its own lawyer. Lawyers do not have to attend the sessions, but it is wise to have the draft agreement reviewed before signing. An employee with a low income can apply for a mediation permit (toevoeging) from the Legal Aid Board (Raad voor Rechtsbijstand).

If proceedings are already pending, the subdistrict court can refer the parties to a mediator through the court’s mediation officer (mediationfunctionaris). The proceedings are then put on hold while the mediation runs.

What should a settlement after mediation record?

If the parties agree to end the employment, they sign a settlement agreement (vaststellingsovereenkomst) under Article 7:900 BW. That agreement must be precise, because the employee’s unemployment benefit (WW) and tax position depend on it.

  • The end date, with the statutory or contractual notice period observed, so that the UWV does not postpone WW benefit.
  • That the initiative came from the employer and that the employee is not to blame (no urgent cause).
  • The amount of any transition payment (transitievergoeding) under Article 7:673 BW or an agreed higher severance payment.
  • Holiday days, bonus, non-competition clause, reference and the return of company property.
  • The employee’s right to withdraw consent within 14 days (Article 7:670b BW). If the agreement does not mention this right, the period is three weeks.

If the parties agree to continue working together, record concrete arrangements: tasks, reporting lines, how often you meet and when you evaluate. A follow-up session after a few months helps to check whether the arrangements work.

Mire kell figyelni alkalmazottként?

Check your rights before you enter mediation, so that you negotiate with figures in mind. The agreement should not cost you your WW benefit.

  • Has the company doctor confirmed whether you are fit to take part in mediation?
  • Do you know your transition payment and notice period?
  • Does the draft settlement state that the initiative came from the employer?
  • Does it mention your 14-day right of withdrawal under Article 7:670b BW?
  • Are deadlines for a claim, such as the two-month period for contesting a dismissal, still running?

Mire kell figyelni munkáltatóként?

Check that mediation fits your reintegration obligations and your file. A failed mediation can still show the subdistrict court that you tried to restore the relationship.

  • Is mediation included in the plan of action and supported by the company doctor’s advice?
  • Have you agreed in writing who pays the mediator and that the sessions are confidential?
  • Do you continue paying salary during sick leave under Article 7:629 BW?
  • Does the settlement observe the notice period, to avoid a WW dispute with the UWV?
  • Is your file on the conflict complete, in case a dissolution on the g-ground becomes necessary?

No. Mediation is voluntary for both sides. During sick leave, however, refusing without good reason to cooperate with reintegration steps advised by the company doctor can lead to suspension of wage payments under Article 7:629 BW.

Who pays for labour mediation?

In practice the employer pays the mediator in an employment conflict, and each party pays its own lawyer. Record this in the mediation agreement before the first session.

Yes, if it ends your employment. Under Article 7:670b BW you can withdraw your consent in writing within 14 days, or within three weeks if the agreement does not mention this right.
